The terms that apply when you download, evaluate, or purchase a licence for any MDM Magic tool.
These Terms & Conditions govern your download, evaluation, purchase, and use of the software applications published by MDM Magic (“we”, “us”, “our”) — including Magic Toolbox and the MDM Reporting Tool (each, the “Software”). By downloading, installing, or using the Software, or by placing an order for a licence, you agree to these terms. If you do not agree, do not install or use the Software.
These terms form a binding agreement between you (or the organisation you represent) and MDM Magic. If you are accepting these terms on behalf of an organisation, you confirm you have authority to bind that organisation, and “you” refers to that organisation.
Our Privacy Policy also applies and is incorporated into these terms by reference.
Each tool is available as a free evaluation download that operates in full for 72 hours from first launch. The evaluation exists so you can confirm the Software meets your needs before paying for it.
We strongly recommend you complete your evaluation before purchasing. Because the evaluation is unrestricted and free, purchasing is a decision you make with full knowledge of how the Software performs in your environment.
At the end of the evaluation period the Software will stop functioning until a valid licence is applied. Evaluation licences are provided for assessment purposes only and may not be used in ongoing production operations.
On receipt of payment in full, we grant you a non-exclusive, non-transferable, perpetual licence to install and use the purchased version of the Software, subject to these terms.
If you need a volume, site, or organisation-wide licence, contact us and we will quote separately.
You must not:
We may deactivate a licence key we reasonably believe has been shared, published, or obtained fraudulently.
Current prices are shown on our Resources page and are quoted in United States dollars (USD). Prices may change at any time; the price that applies to your order is the price displayed at checkout.
Orders are processed by our authorised reseller, FastSpring (FS Commerce Inc. and its affiliates), which acts as Merchant of Record for the transaction. FastSpring handles payment processing, invoicing, and the collection and remittance of any applicable sales tax, VAT, or GST. Your payment is made to FastSpring, and FastSpring's own terms of service and privacy policy apply to that part of the transaction in addition to these terms.
Taxes are calculated at checkout based on your billing location. Any bank charges, foreign exchange fees, or card issuer conversion costs are your responsibility.
The Software is a digital product. There is no physical delivery.
Your licence key is issued automatically by email immediately on successful payment, along with a download or activation link. Delivery is deemed complete at the point that email is sent to the address given at checkout.
If you have not received your key within one hour of purchase, check your spam folder first, then contact us with your order reference and we will reissue it. Non-receipt caused by a mistyped email address, a full mailbox, or a spam filter is not a failure of delivery, but we will always reissue a key to a licensed purchaser on request.
All sales are final. We do not offer refunds for change of mind.
Every tool is offered as a fully functional, unrestricted, free 72-hour evaluation precisely so that you can determine, at no cost and no risk, whether it suits your environment before you pay anything. Because you are able to trial the exact software you are buying, we do not provide refunds where you simply decide after purchase that you no longer want the licence, that you have bought the wrong tool, that you have bought more licences than you need, or that you have found an alternative.
By completing a purchase you expressly request immediate delivery of your licence key and acknowledge that, once that key has been issued, the product has been supplied in full.
Your statutory rights are not affected. Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other consumer protection law that applies to you and cannot lawfully be excluded. In particular, if the Software is faulty, does not do what we have said it does, or is not of acceptable quality, you are entitled to a remedy — which, depending on whether the failure is major, may be a repair, a replacement, or a refund. We will honour those obligations in full.
If you believe the Software is defective or has been misdescribed, contact us before requesting a chargeback. We would far rather fix the problem, and if we cannot, we will deal with your refund entitlement fairly and promptly.
FastSpring, as Merchant of Record, operates its own refund and dispute-resolution policy and may issue a refund independently of us where its policy or the law requires it.
Minor updates and bug fixes for your licensed version are provided free of charge for as long as we continue to maintain that version. Major new versions may be offered as a separate paid upgrade.
Support is provided by email on a best-effort basis. We aim to respond to licensed users within two business days. We do not offer a guaranteed response time or service level unless we have agreed one with you in writing.
We may discontinue a tool at any time. If we do, your perpetual licence for the version you purchased continues, but we may stop issuing updates or providing support for it.
Our tools interact with third-party device management platforms, including Jamf Pro and Microsoft Intune, through their published APIs. We are not affiliated with, endorsed by, or sponsored by Jamf, Apple, Microsoft, or any other platform vendor. All trademarks belong to their respective owners.
Those platforms are outside our control. We are not responsible for changes to their APIs, outages, rate limits, permission models, or licensing terms that affect how our tools work. You are responsible for ensuring that your use of our tools complies with your agreements with those vendors.
You are responsible for your own data. Several of our tools perform destructive or wide-reaching operations — including bulk deletion, cloning between instances, and wiping and restoring entire environments. You must confirm you have a current, tested backup and appropriate authorisation before running them. We strongly recommend testing against a non-production instance first.
We warrant that the Software will perform substantially as described in its documentation and on this website.
Beyond that, and to the maximum extent permitted by law, the Software is provided “as is” without further warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or compatible with every configuration.
Again, this section does not exclude any consumer guarantee that applies to you and cannot lawfully be excluded.
To the maximum extent permitted by law, and except in respect of liability that cannot lawfully be limited:
Where liability under a consumer guarantee cannot be excluded but may be limited, our liability is limited, at our option, to resupplying the Software or paying the cost of having it resupplied.
Your licence terminates automatically if you materially breach these terms, in particular the restrictions in section 4. On termination you must stop using the Software and remove it from your systems. No refund is payable on termination for breach.
We may update these terms from time to time. The version in force at the time of your purchase governs that purchase. Continued use of the Software after we publish an updated version constitutes acceptance of the change for any future orders. The “last updated” date at the top of this page shows when the current version took effect.
These terms are governed by the laws of Australia. The courts of Australia have non-exclusive jurisdiction over any dispute arising from them. If you are a consumer resident elsewhere, you retain the benefit of any mandatory consumer protection provisions of the law of your country of residence.
